License of Dragonfly Automation Software
WARNING: DRAGONFLY AUTOMATION SOFTWARE (DAS) LICENSES ITS
PRODUCTS TO YOU, AND IS PROTECTED BY COPYRIGHT LAW AND INTERNATONAL TREATIES, AS
WELL AS OTHER INTELLECTUAL PROPERTY LAWS AND TREATIES. THE SOFTWARE PROCUCTS ARE
LICENSED, NOT SOLD. UNAUTHORIZED
REPRODUCTION OR DISTRIBUTION MAY RESULT IN CIVIL AND CRIMINAL PENALTIES.
Dragonfly Automation Software grants you the right to use the
enclosed software components per development computer. If you intend to use our
products on 2 development machines, you will need to purchase 2 licenses.
Dragonfly Automation Software License Agreement is a legal agreement between you (either
an individual or a single entity) and Dragonfly Automation Software("DAS"). All
products including software components, demo files, license files and electronic
or printed documentation are under control of this license. By installing,
copying, or otherwise using the DAS products, you agree to be bound by the terms
of this agreement. If you do not agree to the terms of this agreement, do not
install, copy, redistribute, or use, in any sense, the DAS products.
The DAS products are royalty free for use in any compiled binary or web applications.
That means you may distribute your applications with any DAS software components
used in your applications in no royalty fees. You may NOT distribute any
license files, license run-time registry keys or license setup files, and you
may NOT distribute any sample program and electronic or printed
documentation.
No run time fees. If you are writing an application that you intend to distribute
to many end users, there is no additional fee associated with distribution of
your application using Dragonfly Automation Software components. This is true in
all cases unless your application's distribution necessitates the distribution
of Dragonfly Automation Software licensing for our product(s). This would be the
case if:
1. You are creating a container*.
2. You are using Visual Basic, Visual C++ or other
development tools to aggregate our ActiveX component(s) or .Net Components and are distributing the
aggregated component(s).
Note*: A container is a design environment like Visual
Basic that allows developers or end users to drop third-party ActiveX or VBX or .Net
components into it.
Royalty arrangements can be made with Dragonfly
Automation Software if you are building a container and wish to include one or
more of our components as a standard feature of your container. Dragonfly
Automation Software is not interested in royalties for aggregated components
UNLESS the component will ONLY be distributed with your application. Any
aggregated component that you plan to distribute as a stand-alone component will
not be considered as a possible royalty arrangement in this license. You need
directly contact DAS to make a special license agreement.
DRAGONFLY AUTOMATION SOFTWARE LICENSE AGREEMENT
DISCLAIMER:
Dragonfly Automation Software cannot and does not guarantee that any functions contained
in the components will meet your requirements, or that its operations will be
error free. The entire risk as to the software performance or quality, or both,
is solely with the users and not Dragonfly Automation Software. You assume
responsibility for the selection of the component to achieve your intended
results, and for the installation, use, and results obtained from the software.
Dragonfly Automation Software makes no warranty, either implied or expressed. In
no event shall Dragonfly Automation Software be liable to you for damages,
whether direct or indirect, incidental, special, or consequential arising out
the use of any component in the software.
LICENSE GRANT
This is a license, not a sales agreement, between you, the end user; and Dragonfly
Automation Software. Dragonfly Automation Software grants to you a non-exclusive, non-transferable
license to use the copy of the software enclosed in this installation and the
accompanying documentation in accordance with the terms in this License
Agreement.
You may:
a. distribute unlimited copies of the DLL, OCX(minus the license
files) with your products royalty-free;
b. install the software on only one computer;
c. make one (1) copy of the software in machine readable form solely for
backup purposes, provided that you reproduce all proprietary notices on the
copy;
d. transfer the software from one computer to another provided that the
software is used on only one computer at a time;
You may not:
a. distribute license files or license setup files under any
circumstances;
b. use the software on more than one computer, workstation, or file server
at a time in a network or multi-user system;
c. modify, translate, reverse engineer, decompile, disassemble, create
derivative works based on, or copy (except for the backup copy) the software
components or the accompanying documentation;
d. rent or lease any right for the software or documentation in any form to
anyone;
e. remove any proprietary notices on the software, documentation, and
containers;
f. transfer any of your rights under this LICENSE.
Without prejudice to any other rights, Dragonfly Automation
Software may terminate this license if you fail to comply with the terms and
conditions of this license. In such event, you must destroy all copies of the
software, or uninstall the software from any of your computers in which the
software components are installed.
All rights, titles, and all copyrights to the software,
documentation, and any copy made by you remain the property of Dragonfly
Automation Software. Unauthorized copying of the software or the documentation,
or failure to comply with the above restrictions, will result in immediate and
automatic termination of this license and will make legal remedies available to
Dragonfly Automation Software.
If you are building your own container and intend to use
Dragonfly Automation Software controls within the container, royalty-free does
not apply. You will need to contact Dragonfly Automation Software to make
appropriate arrangements.
